PocketLab and ScIC are brands under Myriad Sensors Inc. and this privacy policy refers to all Myriad Sensors brands. At Myriad Sensors, we value your privacy, and it is our priority to protect your information. If you have any concerns about your personal data, please contact us any time.

We have recently reviewed our privacy policy to comply with GDPR (General Data Protection Regulation), and we have assigned a Data Protection Officer to monitor any ongoing privacy concerns. We have audited our business partners including credit card processing, email list management, e-commerce, and others, to verify that they are also compliant with GDPR regulations. If at any time you have a concern about privacy please contact us.

Upon request we will provide you with information about whether we hold any of your personal information. If your personal information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by contacting us. We will respond to your request within 30 days.

 
1. Online Privacy

 

1a. Cookies

We use cookies on our website for tracking and other activity on our product and community site. This helps enhance your experience on our site. If you prefer, you can refuse to use cookies and our website will work normally. We may use aggregated traffic data with business partners or for research, but we will never disclose individual personal data without your explicit permission.

 

2. Facebook Privacy

Below is our privacy policy in association with Facebook products.

 

2a. Facebook Pixel Tracking

We use the “visitor action pixels” from Facebook Inc (1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”)) on our website. This allows user behavior to be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes. The data collected in this way is anonymous to us, i.e. we do not see the personal data of individual users. This data is stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for Facebook’s promotional purposes, in accordance with Facebook’s Data Usage Policy https://www.facebook.com/about/privacy/. You can allow Facebook and its partners to place ads on and off Facebook. A cookie may also be stored on your computer for these purposes. The legal basis for the use of this service is in Article 6, paragraph 1, sentence 1, letter f of GDPR. 2b. Facebook Page

When you visit our Facebook Pages, which we use to represent our company or individual products or services, some of your personal data will be processed. The sole controller responsible for the processing of personal data is Facebook Ireland Ltd (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland, “Facebook”). 2c. Processing of Page Insights

Facebook provides us with anonymized statistics and insights for our Facebook page, which help us to understand the types of actions that people take on our Page (so-called “Page Insights”). These Page Insights are created based on specific information about individuals who have visited our Page. This processing of personal data is carried out by Facebook and by us as joint controllers. The processing serves our legitimate interest to evaluate the types of actions being taken on our Page and to improve our Page based on these findings. The legal basis for this processing is Article 6, paragraph 1, letter f of GDPR. We are in no case able to assign the information obtained via Page Insights to a specific Facebook profile using the “Like” data for our Page. We have reached an agreement with Facebook to share joint responsibility for the processing, in which the division of data protection obligations between ourselves and Facebook is set out. 2d. Processing Facebook page data

We also process data that you make available to us via our Facebook Pages. Such information might be your Facebook user name, your player name in one of our games, contact details or a communication to us. We only process this personal data if we have previously expressly asked you to share this data with us, for example as part of a survey or a competition. This processing will be done by us as the sole data controller. If you have communicated data to us because you are taking part in a contest, we will only process this if it is necessary to send you a prize. After delivery of the prize, or if you do not win, your data will be deleted. The legal basis for this processing is Article 6, paragraph 1, letter b, of GDPR. Personal data that we have collected through surveys will be processed in anonymized form, to ensure that customers are happy with our offers. This processing serves our legitimate interest of continuously improving our offers, and the legal basis therefore is Article 6, paragraph 1, letter f, of GDPR.

 

3. Google Privacy

Below is our privacy policy in association with Google products.

 

3a. Google Analytics

We use the Google Analytics service from Google USA 1600 Amphitheatre Parkway Mountain View, CA 94043 ) to analyze our website visitors. Google uses cookies. The information generated by the cookie about the use of the online product or service by users is generally transferred to a Google server in the USA and stored there. Google will use this information on our behalf to evaluate the use of our online products and services by users, to compile reports on the activities within these online products and services and to provide us with further services associated with the use of these online products and services and the use of the internet. Pseudonymous user profiles can be created from the processed data. We use Google Analytics only with IP anonymization enabled. This means that Google will truncate the IP address of users within Member States of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The IP address transmitted by the user’s browser is not merged with other Google data. Users can prevent cookies from being stored by adjusting the settings to their browser software accordingly. The legal basis for the use of this service is Article 6, paragraph 1, sentence 1, letter f, of GDPR. 3b. Google Marketing Services

We use the Google marketing and remarketing service from Google USA (1600 Amphitheatre Parkway Mountain View, CA 94043) to analyze our website visitors.These services allow us to display advertisements in a more targeted manner in order to present advertisements of interest to users. Through remarketing ads and products are displayed to users relating to an interest established by activity on other websites within the Google Network. For these purposes, a code is used by Google when our website is accessed and what are referred to as (re)marketing tags are incorporated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user’s device (comparable technologies may also be used instead of cookies). Cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. This file records which apps users have visited, which content they are interested in and which offers have been used. In addition, technical information about the browser and operating system, referring websites, the length of the visit as well as any additional data about the use of the online products and services are stored. The IP address of users is also recorded, although we would like inform you that within the framework of Google Analytics, IP addresses within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area are truncated. All user data will only be processed as pseudonymous data. Google does not store any names or e-mail addresses. All displayed ads are therefore not displayed specifically for a person, but for the owner of the cookie. This information is collected by Google and transmitted to and stored by servers in the USA. One of the Google marketing services we use is the online advertising program Google AdWords. In the case of Google AdWords, each AdWords customer receives a different conversion cookie. Cookies can therefore not be tracked through the websites of AdWords customers. The information collected by the cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they will not receive any information that personally identifies users. We may include third-party advertisements based on the Google Marketing Service called DoubleClick. DoubleClick uses cookies to enable Google and its partner websites to place ads based on users’ visits to this website or other websites on the Internet. Google services make use of Google’s Tag Manager. 4. Twitter Privacy

Below is our privacy policy in association with Twitter products.

 

4a. Conversion Tracking

On our website, we use the Conversion Tracking Service of Twitter Inc. (1355 Market Street #900, San Francisco, California 94103, “Twitter”). Twitter stores a cookie on the user’s computer to enable an analysis of the use of our online products and services. Twitter Conversion Tracking tracks the actions of users after they have viewed ads or interacted with ads on Twitter. Twitter’s Conversion Tracking allows you to assign conversions such as link clicks, retweets or “like” data. The legal basis for the use of this service is Article 6, paragraph 1, sentence 1, letter f, of GDPR. If you wish to object to tracking, you can do so using the Digital Advertising Alliance tool at optout.aboutads.info.

5. ScIC Privacy Policy

By registering to an ScIC virtual unconference by PocketLab, users are confirming that they (a) are over 13 years of age, and if not, that they have an adult's consent to be attending this online event hosted by ScIC (b) Attendees are aware that, when applicable, the meeting could be recorded and pictures and videos taken during the party might be shared on different social media platforms as ScIC sees fit. During applicable events, attendees will have the option to have their cameras on or off.

PocketLab is committed to protecting and respecting your privacy, and we’ll only use your personal information to administer your account and to provide the products and services you requested from us. Registration to the ScIC virtual events adds you to the PocketLab and ScIC newsletters to share follow-up content and future event promotions. Occasionally, we share registration information with trusted ScIC partners in order to follow up with information presented at our events. Registrants consent to allow ScIC and PocketLab to store and process the personal information submitted above to provide you the content requested. Registrants can unsubscribe from these communications at any time.

 

6. POCKETLAB NOTEBOOK PRIVACY

6a. Account Types

You may need to create an account to use some of our Services. You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

Teacher Accounts: Only persons over the age of 18 can create a teacher account. You can learn more about teacher accounts below.

Student Accounts: Users who are under the age of 13 need consent from their parents/guardians to have a student account.  Users can always connect a PocketLab and collect PocketLab sensor data without an account if they wish to do so.

Student accounts are created by the Teacher account either manually or through an integration with Google Classroom. You can learn amount about student accounts below.

Student accounts do not receive emails or other forms of communication from PocketLab.

You can control most communications from the Services. If you have a teacher account, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, and you may not be able to opt out from receiving them. 

 

6b. Personal Data

We aim to collect as little personal data from our users as possible in our software. We collect some personal data from our teacher users who must be 18 years of age or older to create an account so that we can better support teachers using PocketLab software and products in their classroom. Student users can use our app without an account to collect data with their sensor. If a teacher creates student accounts for their students, the students can log in to the PocketLab software to access more features of the software and to participate in the teacher’s classroom. Users who are under the age of 13 need consent from their parents/guardians to have a student account. Users can always connect a PocketLab and collect PocketLab sensor data without an account if they wish to do so. 

We do not knowingly collect personal information from children under the age of 13 without prior verifiable parental consent. If you are the parent or guardian of a child under the age of 13 and believe we may have collected personal data, please contact us so we can delete the information.

6c. PocketLab Notebook Data

Within the PocketLab Notebook app, there are three types of student accounts. Standard PocketLab student accounts are created manually by the student’s teacher. The students are given a class code, a student code, and a username to log in provided by the teacher. We recommend the teacher use aliases for the students rather than student names when creating student accounts. Google PocketLab Student accounts are created through an integration with Google Classroom. If a teacher opts to use the Google Classroom integration when creating PocketLab Classes and student accounts, the student accounts are created using the student’s Google Classroom credentials. The student username in the PocketLab app will be generated by their display name in Google Classroom. Teachers can adjust this in their Google Classroom accounts. Teachers do not have to use the Google Classroom integration to use the PocketLab software with their students. The PocketLab app stores student usernames in the teacher’s roster and as avatars when students work on lesson assignments within the app. The purpose of this is to allow the teacher to see the work of their students within the app. 

ClassLink student accounts are created through an integration with ClassLink and the PocketLab App. An administrator at the teacher's School or District needs to submit a request with PocketLab for authorization of the use of the integration. The integration will automatically generate student user accounts. ClassLink Student Users use a ClassLink Single Sign-On to access the PocketLab Materials. As part of a requirement of the ClassLink integration, PocketLab stores ClassLink Student Users email addresses. ClassLink Student Users do not receive emails or other forms of communication from PocketLab.

 

6d. Location Privacy

Location data can enhance measurement data collected with the weather and climate sensors on PocketLab Air, PocketLab Weather, PocketLab Thermo, and PocketLab Voyager. The software gives users the option to allow permission to location data from their connected device. The location data does not come from the PocketLab sensor. The location data is graphed alongside weather and climate data from PocketLab sensors so that users can visualize that measurement data on a map. If a user saves this measurement data in their account, this data is stored by the app. This can be deleted at any time by the user and the user can always turn off the location data permission. 

PocketLab software does collect usage statistics to better understand how our software is used. We do not share this data with third parties. This data is anonymous with student accounts. 

 

7. PocketLab Customers

Customers may subscribe to email alerts, purchase online, submit support requests, or send us your email, we may collect information including your email address, IP address, name, address, phone number, and other information that you provide. This information will only be used for order fulfillment, periodic updates, support, special promotions, or other general updates. We will not give or sell this information to any third party. We do not store credit card information on our servers. All our email updates include a link to opt out of future emails.

 

8. Additional Policy Terms

We reserve the right to change these terms occasionally. The changes will not be retroactive, and the most current version of the Terms, will govern our relationship with you. We will do our best to notify you of material revisions, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.

The laws of the State of California, excluding its choice of law provisions, will govern these Terms and any dispute that arises between you and Myriad Sensors, Inc. All disputes related to these Terms or the Services will be brought solely in the federal or state courts located in Santa Clara County, California, United States, and you consent to personal jurisdiction and waive any objection as to inconvenient forum.

If you are a federal, state, or local government entity in the United States using the Services in your official capacity and legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you. For such U.S. federal government entities, these Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California (excluding choice of law).

In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. Myriad Sensors' failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
